Maulana Mahmood Madani appealed to the government to maintain the principles of the Constitution on Waqf, asked the mutawallis to keep the records safe.

Jamiat Ulama-e-Hind President Maulana Mahmood Madani on Friday appealed to the central government to follow constitutional principles while implementing the Waqf (Amendment) Act, 2025. He said that the credibility of the law lies in its being equally applicable to all citizens. Addressing the All-India Mutawallis Conference organized by Jamiat Ulema-e-Hind at Aiwan-e-Ghalib, New Delhi, Maulana Madani said that justice should remain the guiding principle of governance. The UP government had decided the new rules for the formation of Waqf Board a few days ago.

He warned that any deviation from constitutional values ​​would undermine public confidence in the rule of law. He said, “Justice is not a favor to any community, it is the greatest strength of the state. The law is respected only when it is applied equally to every citizen.”

Internal weaknesses are a big challenge for Waqf properties.

Maulana Madani said that the challenges facing Waqf properties are not only from external pressures but also from internal weaknesses. These include administrative negligence, poor management and improper preservation of legal records. He appealed to Mutawallis across the country to strengthen institutional management – ​​through proper documentation, digitization of records, financial transparency, regular audits and timely legal action against encroachments.

Protection of Waqf is a religious responsibility

Describing Waqf as “a trust in the name of Allah and one of the permanent pillars of the Islamic faith”, he said protecting Waqf properties, safeguarding documentary records and seeking legal remedies when needed should be seen as a religious obligation. He said, “The protection of Waqf cannot be left only to the mutawallis. It is the collective responsibility of the entire Muslim community. The community which neglects it ultimately loses the protection of history as well.” He further said, “If we work with honesty, planning and determination, develop capable leadership and involve the wider community in this mission, every conspiracy against Waqf can be defeated.”

More than 500 mutawallis, scholars, legal experts and public representatives participated in this conference. It was presided over by Syed Shah Hafiz Mohammad Ali Al-Hussaini, the master of Dargah Hazrat Khwaja Banda Nawaz Gesu Daraz of Gulbarga.

Syed Shah Mohammad Ali Al-Husseini: Awareness must now be translated into systematic legal preparation and effective management. Appeal to philanthropists to create new Waqfs for education, health and public welfare.

Advocate Nasir Aziz: Waqf protection committees and special legal cells should be formed across the country.

Harinder Malik said that the income of Waqf should mainly be for the poor and needy. Maulana Mohibullah Nadvi talked about a national movement to protect Waqf institutions. Imran Masood said that disputes over religious properties are not limited to just one community.
