New Delhi: The Supreme Court has termed the nearly 10-year-long dispute between an estranged husband and wife as a “marital Mahabharata” and annulled the marriage of the two, giving a “full stop” to the bitter legal battle. A bench of Justices Vikram Nath and Sandeep Mehta said the marriage was “practically dead” and used its extraordinary powers under Article 142 of the Constitution to dissolve the marital relationship.
The bench criticized the husband, a lawyer by profession, for using his legal expertise to file over 80 cases against his wife, her family and even his lawyer as part of a “vindictive and harassing” campaign.
‘The husband tried to complicate the proceedings by filing countless complaints’
The bench, in its order, said the estranged spouses were “embroiled in a long-running bitter matrimonial dispute, resulting in multiple suits being filed in various courts.” “We also take cognizance of the fact that the respondent husband tried to drag out and complicate the proceedings at every level by filing innumerable applications and complaints against not only the petitioner wife and her relatives but also her lawyers. Most of these cases appear to be vindictive and harassing. This clearly reflects the hostile, vindictive and vindictive attitude of the respondent husband,” the order said.
‘This marriage is practically dead’
The bench said that it could guess the reason due to which the woman would have found it extremely difficult to continue her marital relationship. This Court has no doubt that the marriage has practically died out and the said case is a very appropriate case to exercise the powers conferred by Article 142 of the Constitution, not only to dissolve the marriage between the parties, but also to put an end to all proceedings initiated and pending between them, including the proceedings against the relatives and legal advisors, so as to do complete justice and put an end to the dispute which has been going on for almost a decade, which has crossed all limits. And has taken the form of marital Mahabharata.”
How many crores will the wife get?
The Supreme Court directed the respondent husband to pay Rs 5 crore for the maintenance of the petitioner wife and her children. The plaintiff husband will have to pay this amount in one go or in four installments within a year. With this, the court quashed all 80 pending cases including all civil, criminal and FIRs with immediate effect. Full custody of both the sons has been given to the wife, although the husband has been reserved the right to meet the children.
