Sonam Raghuvanshi, the accused wife in the murder case of Indore transport businessman Raja Raghuvanshi during his honeymoon in Meghalaya, has received a big blow from the Supreme Court. The Supreme Court has canceled the bail of Sonam Raghuvanshi. The Supreme Court has ordered Sonam Raghuvanshi to surrender in three weeks. The Supreme Court said that if the trial is delayed, then Sonam Raghuvanshi can file a bail petition again after 6 months.
Who filed the petition?
The Meghalaya government had filed a petition in the Supreme Court against the bail granted to accused wife Sonam Raghuvanshi. During the hearing, Sonam Raghuvanshi’s lawyer said that a total of 94 witnesses have been made in this case, out of which statements of only 4 witnesses have been recorded so far. Supplementary charge sheet has also been filed and he has been granted bail with strict conditions. Sonam’s lawyer said that she has not surrendered, she was arrested from Ghazipur in UP, her arrest is being described as surrender. Sonam’s lawyer said that she is following the strict conditions of bail. There is no danger of absconding.
On behalf of the Meghalaya government, SG Tushar Mehta said that the ground of arrest being cited has no basis, because the accused himself had surrendered and this is also recorded in the charge sheet.
What did the court say in the last hearing?
During the last hearing, the Supreme Court had given two options to Sonam’s lawyer and asked whether Sonam Raghuvanshi would surrender or the court should decide on canceling her bail. Whereas in her reply filed in the Supreme Court, accused Sonam Raghuvanshi declared herself innocent and said that she has been falsely implicated in this case and the entire case of prosecution against her is based on circumstantial evidence. In such a situation, he cannot be considered guilty on the basis of allegations alone.
SG Tushar Mehta, on behalf of the state government, had told the Supreme Court that there was a mistake in typing the number of only one legal section in the document. Bail should not be granted on the basis of such a small technical mistake. Tushar Mehta said that if the bail is maintained, there is a possibility of Sonam absconding.
Important comment of Supreme Court
While canceling Sonam’s bail, the Supreme Court said that these things are inevitable in a changing society. Today’s generation may be more knowledgeable than us, but they are weaker in handling pressure. SG Mehta said that he has more information, not knowledge. Justice Varale said that whatever is being shared on WhatsApp is being considered as knowledge.
