Does the Election Commission have the authority to do SIR or not? Supreme Court will give important decision today

The Supreme Court will pronounce its verdict today on petitions challenging the validity of SIR. The bench of Chief Justice of India Surya Kant and Justice Joymalya Bagchi will give this verdict on a batch of petitions. The Supreme Court will decide whether the Election Commission has the powers under Article 326 of the Constitution, the Representation of the People Act 1950 and the rules made thereunder to conduct SIR in its present form.

The decision was reserved on January 29

According to a report published in Line Law, the Supreme Court had reserved its decision in this case on January 29. Till now, no stay has been imposed by the court on the SIR process and this process has been completed in Bihar, Kerala, Tamil Nadu, Puducherry and West Bengal. This is still going on in many states like UP, Gujarat and Rajasthan.

MPs from different parties included among the petitioners

Most of these petitions were filed in June 2025 after the Election Commission decided to conduct SIR in Bihar. These include the names of The Association of Democratic Reforms, Political Activist Yogendra Yadav, TMC MP Mahua Moitra, RJD MP Manoj Jha, Congress MP KC Venugopal, NCP SP MP Supriya Sule and other petitioners.

Important instructions were given on Aadhar card during the hearing

During the hearing last year, the Supreme Court had directed the Election Commission to consider Aadhaar card as the ’12th document’ that can be produced as identity proof for inclusion in Bihar’s revised voter list. However, the Supreme Court had made it clear that Aadhaar will not be proof of citizenship. Election Commission officials can check the authenticity and genuineness of the Aadhaar card presented by the voters.
