Indian cricket team’s young star Abhishek Sharma has got the support of Delhi High Court. Delhi High Court has issued an interim order protecting the personality rights of Indian cricketer Abhishek Sharma. While prohibiting unauthorized use of his name, photograph, video and identity, the court has made it clear that misuse of any person’s image for commercial or personal gain cannot be accepted. This order will also be applicable to fake content generated by AI and merchandise being sold without permission.
The court has directed Meta, other social media platforms and e-commerce websites to immediately remove objectionable content related to Abhishek Sharma and related links. The court also made it clear that without his permission, his name, photograph, video or identity cannot be used in any commercial or personal way.
Court’s strictness on fake content created by AI
In the petition filed by Abhishek Sharma, it was alleged that some social media accounts are creating fake photos and videos of him and circulating them on the internet with the help of artificial intelligence. These materials were causing damage to his reputation, professional image and personal dignity. The petition also said that indecent and objectionable content was being shared along with many morphed photographs. Apart from this, some sellers were using his picture and name to sell T-shirts and other products without permission, thereby taking commercial advantage of his identity.
Image was being affected by false content
In the interim order passed on July 9, Justice Jyoti Singh said that Abhishek Sharma is one of the key players of the Indian cricket team and is rapidly making his mark in international cricket. The court held that the material being circulated on social media is false and obscene, which harms their public image.
Summons had already been issued
In this case, Delhi High Court had already issued summons to the concerned parties. The court had directed that notices be sent to the defendants through other legal means including social media. Advocate Gaurav Bahl, appearing for Abhishek Sharma, told the court that many objectionable URLs included in the complaint have been removed. Advocate Varun Pathak, appearing on behalf of Meta, said that now only two such links are left on the company’s social media platforms, on which the process of action is going on.
