New Delhi: The petition of AISA President Neha Bora is being heard in Delhi High Court. The bench of Justice Subramaniam Prasad is hearing this case. The petition on behalf of Neha Bora has challenged the notice issued by the Special Executive Magistrate (SEM), in which she was directed to pay a bond of Rs 10,000 and maintain peace. Advocate Gopal Shankar Narayan is appearing on behalf of the petitioner, while ASG Chetan Sharma, on behalf of Delhi Police, has raised questions on the maintainability of the petition.
Notice issued under section 126 and 130 of BNSS challenged
Neha Bora’s lawyer Gopal Shankar Narayan said in the court that this matter is related to the notice issued under sections 126 and 130 of the Indian Civil Security Code (BNSS). He said that the petitioner is an active leader of AISA and has been demanding reforms in the policies of the government. He had appealed to people through social media to join the protests, but did not incite violence anywhere. According to him, Neha Bora’s protests have been peaceful.
Call for demonstration against denotifying Jantar Mantar
Gopal Shankar Narayan told the court that a press conference was held at the Press Club on October 15. After this, a post was posted on social media at 4 pm on October 16, in which displeasure was expressed over the sudden denotification of Jantar Mantar. In the post it was said to meet at Mandi House. Neha Bora’s lawyer argued that in this post there was no talk of inciting violence, breaking the law, disturbing peace, disturbing public order or gathering people to commit any crime.
Accused of detaining within 10-15 minutes of demonstration
Gopal Shankar Narayan said that on the evening of October 16, when Neha Bora called for a protest and reached the Mandi House area, she was taken into custody within 10-15 minutes. According to the lawyer, Neha Bora had not committed any crime at that time. He raised only a few slogans, after which he was taken into custody. Neha Bora’s lawyer termed this action as completely illegal detention. He said that at night Neha Bora was taken to R.K. Puram police station and till morning no one had any idea where he was kept.
